1. Introduction
This Privacy Policy describes how PropOp ("PropOp," "we," "us," or "our"), operated by Crestedge Real Estate LLC at 3021 Ridge Road Ste. A78, Rockwall, TX 75032, collects, uses, and shares information when you use our website, applications, and related services (collectively, the "Service").
PropOp is a marketplace platform that connects licensed real estate agents who have active listings with licensed real estate agents who create social media content featuring those listings. Both types of users are referred to collectively as "users" or "you" throughout this policy.
By creating an account, accessing, or using PropOp, you agree to the practices described in this Privacy Policy. If you do not agree, do not use the Service.
This policy works alongside our Terms of Service.
2. Information we collect
We collect information in three ways: information you provide directly, information generated through your use of the Service, and a limited amount of information from third parties.
2.1. Information you provide
When you register and use PropOp, you provide:
- Identity and contact information. Your full name, email address, direct phone number, sponsoring brokerage, and a profile photo or headshot.
- Professional credentials. Your real estate license number and license status, as issued by your state licensing authority.
- Social media handles. Your Instagram, YouTube, Facebook, and other public social media usernames where you publish content. (PropOp does not connect to or authenticate against these accounts, we store only the handles you choose to provide.)
- Listing information. If you are a Listing Agent, the property addresses, prices, photographs, descriptions, MLS numbers, scheduling instructions, and seller-consent confirmations for the listings you upload.
- Content submission information. If you are a Content-Creating Agent, the URLs of posts you publish on third-party platforms and submit to PropOp under your obligation to do so within seven days of publication.
- Communications. Any information you provide when you contact us, report another user, or respond to surveys.
2.2. Information generated through use
When you use the Service, we automatically collect:
- Activity information. Listings you upload, listings you view, listings you request access to, post URLs you submit, and dates and times of these actions.
- Device and technical information. IP address, browser type and version, device type, operating system, language preference, and referring URL.
- Cookies and similar technologies. We use a limited set of cookies for authentication, session management, and basic platform analytics. See Section 6.
2.3. Information from third parties
- License verification. We may verify the license number you provide against your state's real estate licensing authority public lookup. This confirms only that a license exists, its status, and the name associated with it. We do not retrieve additional information beyond what is necessary to confirm your eligibility for the Service.
- Public social media information. When you submit a post URL, we may retrieve publicly available metadata about that post (such as platform name, post date, and, for YouTube videos, public view counts and engagement statistics via YouTube's public Data API). We do not access private posts, direct messages, or any information that requires authentication into your social media accounts.
3. How we use information
We use the information we collect to:
- Operate the Service. Authenticate your account, display listings to eligible users, route access requests between Listing Agents and Content-Creating Agents, and store the post URLs you submit.
- Provide notifications. Email Listing Agents when their listings receive access requests, including the requesting agent's name, brokerage, direct phone, email, and social media handles. Email users about platform updates, policy changes, and support matters.
- Generate reports. Aggregate post submissions and public metrics into reports that Listing Agents can view in their dashboards and forward to their seller clients.
- Verify eligibility. Confirm that registering users hold an active Texas real estate license and meet our eligibility requirements.
- Maintain platform safety. Investigate reports of rule violations, identify users who have breached the Terms of Service, and remove violators from the platform.
- Improve the Service. Understand how users interact with PropOp so we can fix bugs, add features, and make the Service more useful. Where possible, this analysis is performed on aggregated, de-identified data.
- Comply with the law. Respond to lawful requests from courts or government authorities, enforce our Terms, and protect the rights, property, or safety of PropOp, our users, or others.
We do not use your information to train artificial intelligence models or to sell to data brokers or marketing networks.
4. How information is shared
PropOp shares information only as described below.
4.1. Between users (the core function of the Service)
The Service is designed to share certain information between Listing Agents and Content-Creating Agents:
- When a Content-Creating Agent requests access to your listing, you (the Listing Agent) receive their name, sponsoring brokerage, direct phone number, email address, and social media handles, so that you can coordinate the visit and verify the resulting posts.
- When you upload a listing, basic property information (address, price, photos, beds, baths, size, scheduling method) is visible to other approved PropOp users who can browse and request access to it.
- Your profile information, name, headshot, brokerage, and social media handles, is visible to other PropOp users in the context of listings you've uploaded or content visits you've requested.
This sharing is the function of the marketplace, and using PropOp means you accept it.
4.2. With service providers
We share limited information with vendors who help us operate the Service, including:
- Hosting and infrastructure providers (such as our database, file storage, and application hosting providers)
- Email delivery providers (for transactional notifications)
- Analytics providers (for basic usage analytics, where used)
- License verification providers (if a third-party API is used to verify TREC licenses)
These providers are contractually limited to using your information only to provide their services to PropOp.
4.3. With legal authorities and others
We may disclose information when we believe in good faith that disclosure is necessary to:
- Comply with applicable law, regulation, legal process, or governmental request;
- Enforce our Terms of Service, including investigation of potential violations;
- Detect, prevent, or otherwise address fraud, security, or technical issues;
- Protect the rights, property, or safety of PropOp, our users, or the public.
4.4. In the event of a business transfer
If PropOp is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, your information may be transferred as part of that transaction. We will notify users by email and post a notice on the Service before any such transfer takes effect.
4.5. With your consent
We may share your information for other purposes with your explicit consent.
4.6. What we do not do
- We do not sell your personal information.
- We do not share your information with advertisers for targeted advertising.
- We do not provide your information to data brokers.
- We do not access your social media accounts directly or read private content from them.
5. Data retention
We retain your information for as long as your account is active and as long as needed to provide the Service.
- Account information. Retained while your account is active. After account deletion, we retain only the information required to comply with legal obligations, resolve disputes, and enforce our agreements (typically up to two years), after which it is deleted or de-identified.
- Listing information. Retained for as long as the listing is active in the Service. Inactive or removed listings, and their associated activity logs, are retained for up to twenty-four (24) months for reporting and dispute-resolution purposes, then deleted or de-identified.
- Post URLs. Retained for as long as needed to provide reporting to the relevant Listing Agent, and for up to twenty-four (24) months after a listing is closed.
- Communications. Support communications are retained for up to thirty-six (36) months for quality and dispute-resolution purposes.
6. Cookies and tracking
PropOp uses cookies and similar technologies in a limited way:
- Essential cookies keep you signed in and remember your session preferences. These cannot be turned off without breaking the Service.
- Analytics cookies help us understand how users navigate the Service so we can improve it. These collect aggregated, non-identifying information about page visits, click paths, and feature usage.
We do not use third-party advertising cookies, retargeting pixels, or cross-site tracking.
You can control cookies through your browser settings. Disabling essential cookies will prevent the Service from working.
7. Your choices and rights
7.1. Account information
You can review, update, or correct your account information at any time through your account settings, or by contacting us at hello@heypropop.com.
7.2. Communications
You will receive transactional emails (access request notifications, password resets, security notices, and important platform notices) as a normal part of using the Service. These cannot be turned off without closing your account.
Any non-transactional communications (such as product updates or newsletters) will include unsubscribe instructions, and you can opt out at any time.
7.3. Deleting your account
You can permanently delete your account at any time directly from your account settings, under "Delete account." When you do, we immediately and permanently erase your profile, all of your listings and their photos, your leaderboard rankings and activity history, and every content request you have made or received.
This action is permanent and cannot be undone. Deleted information cannot be recovered. Because deletion is immediate and irreversible, we ask you to confirm that you intend to delete your account before it proceeds.
If you would prefer, you may also request deletion by contacting us at hello@heypropop.com. In limited cases we may retain certain information after deletion only where we are legally required to do so, as described in Section 5 (for example, to comply with law, resolve disputes, or enforce our agreements).
7.4. Texas residents
If you are a Texas resident, the Texas Data Privacy and Security Act (TDPSA) may give you additional rights, including the right to:
- Confirm whether we process your personal information and access that information;
- Correct inaccuracies in your personal information;
- Delete personal information we have collected from or about you;
- Obtain a copy of your personal information in a portable format;
- Opt out of certain processing activities, including targeted advertising and the sale of personal information (which PropOp does not engage in regardless).
To exercise these rights, contact us at hello@heypropop.com. We will respond within forty-five (45) days, as required by law. You may appeal a denial by contacting us at the same address, and if your appeal is denied, you may contact the Texas Attorney General.
7.5. Other state residents
If you are a resident of another U.S. state with applicable privacy laws (such as California, Colorado, Virginia, Connecticut, or Utah), you may have similar rights. Contact us at hello@heypropop.com to exercise them, and we will honor your request to the extent required by law.
8. Information security
We use commercially reasonable administrative, technical, and physical safeguards to protect your information against unauthorized access, alteration, disclosure, or destruction. These include encryption in transit (HTTPS), encryption at rest where applicable, access controls, and regular review of our security practices.
No method of transmission over the internet or electronic storage is 100% secure. While we work to protect your information, we cannot guarantee absolute security. If we become aware of a security incident that affects your information, we will notify you in accordance with applicable law.
9. Children's privacy
PropOp is intended for licensed real estate professionals over the age of eighteen (18). The Service is not directed to children, and we do not knowingly collect information from anyone under eighteen. If you believe a child has provided us with information, please contact us at hello@heypropop.com and we will delete it.
10. International users
PropOp is operated from the United States. If you access the Service from outside the United States, you understand that your information will be transferred to, stored in, and processed in the United States, and that U.S. law may differ from the privacy laws of your country.
11. Changes to this Privacy Policy
We may update this Privacy Policy from time to time. When we do, we will post the updated policy with a new "Last updated" date. For material changes, we will provide notice to active users by email at least seven (7) days before the changes take effect.
Your continued use of the Service after the effective date of an updated policy constitutes acceptance of the updated policy.
